Scope: Applies to all users, distributors, DSPs, and third parties interacting with Recognition Group’s services or content.
2. Prohibited Activities
Piracy includes, but is not limited to:
Unauthorized Distribution:
- Sharing music via torrents, peer-to-peer networks, or unlicensed platforms.
- Selling or distributing physical/digital copies without permission.
Illegal Streaming: - Hosting music on unauthorized websites or apps.
- Broadcasting unlicensed public performances (e.g., clubs, radio).
Counterfeit Content: - Creating fake albums, compilations, or remixes using copyrighted material.
- Altering metadata to bypass copyright detection.
Bootleg Recordings: - Distributing live performances or unreleased tracks without consent.
3. Our Anti-Piracy Measures
Proactive Protection
- Content ID Systems: Monitor DSPs and social platforms (YouTube, TikTok) for unauthorized use.
- Takedown Requests: Issue DMCA-compliant notices to remove pirated content.
- Partnerships: Collaborate with SAMRO, CAPASSO, and international anti-piracy organizations.
Detection Tools
- Digital Fingerprinting: Track music across platforms using ISRCs and watermarking.
- Web Crawlers: Scan for illegal downloads/streams on file-sharing sites.
4. Enforcement & Penalties
For Users/Artists
- First Offense: Warning + removal of infringing content.
- Repeat Violations: Account termination + forfeiture of unpaid royalties.
- Legal Action: Pursued under South Africa’s Copyright Act No. 98 of 1978 (fines up to R5,000 per infringing copy or 5 years imprisonment).
For Third Parties
- Takedown Notices: Immediate removal of pirated content.
- Litigation: Civil lawsuits for damages (actual losses + statutory penalties).
5. Artist & Label Responsibilities
- Monitor Usage: Report suspected piracy within 48 hours via support@recognitiongroup.co.za.
- Secure Releases: Avoid leaking pre-release tracks or stems.
- Verify Partnerships: Only work with licensed distributors and DSPs.
6. Reporting Piracy
To report copyright infringement:
- Email: support@recognitiongroup.co.za with:
- Your name, artist/label name, and contact details.
- Links to pirated content + proof of ownership (e.g., ISRCs, copyright certificates).
- Investigation: We’ll act within 72 hours and notify you of outcomes.
7. Education & Awareness
- Artist Resources: Guides on protecting releases (e.g., watermarking demos).
- Industry Collaboration: Workshops with SAMRO and RiSA (Recording Industry of South Africa).
8. Legal Compliance
This policy adheres to:
- South African Copyright Act (1978).
- EU Directive on Copyright in the Digital Single Market.
- US Digital Millennium Copyright Act (DMCA).
